Limitations of Liability
The amount of any loss to which the carrier is liable shall not exceed $2.00 per pound ($4.41 per kilogram) or $500 for the entire shipment. Where no declared value has been specified, the carriers maximum liability will be up to a maximum weight of 250lbs or, if higher value has been declared and a corresponding insurance fee charged, to a maximum of 500lbs. In no event shall the carrier’s liability exceed $1,000.00.
The claimant agrees that notwithstanding any disclosure of the nature or value of the goods, the amount of any loss or damage, including consequential, incidental or indirect damage, loss of earnings or profits resulting from the loss of or damage to the goods and /or misdelivery, failure to deliver or delay in delivery of the goods, shall not exceed the maximum liability of Karmar Delivery Service Inc.
The carrier shall have no liability for any loss or damage, or claim, to any party, except to the consignor and/or consignee, and the liability to the consignor/consignee, and the liability to the consignor/consignee shall be limited to the terms and conditions of the contract.
The carrier shall not be liable for any loss, damage, destruction or unreasonable delays arising from the following causes:
- Acts of God, the Queen’s or public enemies.
- Riots, Strikes, Lockouts or other labour disputes.
- Authority of Law.
- Acts or omissions of customs or similar authorities.
- Act or default of the shipper or owner of the goods.
- Power Disruption.
Proper Packaging
If packaging is damaged in transit, it must be so noted upon delivery. Claims made on shipments signed for in good order will not be processed. Claimant agrees that notwithstanding any disclosure of the nature or value of the goods, the amount of any loss or damage, including consequential, incidental or indirect damage, loss of earnings or profits resulting from the loss of or damage to the goods, shall not exceed the maximum liability as set out above.
Incomplete Address
Karmar Delivery Service Inc. reserves the right to apply an additional charge to shipments which show the consignee’s address as a rural route number, post office box number or an address which is incomplete to cover additional costs incurred in locating the consignee
Damage or Loss Claim
Notice of loss or damage must be given to the carrier at its head office within 24 hours after such loss or damage becomes known, and within 10 days after the shipments is accepted by the carrier. A written notice of intent to claim must be received at Karmar Delivery Service Inc within 24 hours of acceptance of the shipment by the Carrier.
The claim must include:
- a copy of the waybill or manifest covering the shipment,
- the reason and description of the claim (i.e. loss or damage),
- support documents to show the value of the shipment.
Guarantees
No delivery times are guaranteed.
Proof of Delivery
Where a consignee cannot be found at the time of delivery, the carrier is under no obligation to obtain a signature and/or notify the consignor(s) or consignee(s) if it is delivered or not delivered.
Wait Time
A “Wait Time” charge will apply after 30 minutes for every 15 minute interval Karmar Delivery Service Inc’s agents are required to wait for either a pick up or delivery of a shipment. Please inquire for details of our “Wait Time” rates.
